Terms of Service
Provided by AutoMechanics LLC
These Terms of Service (“Terms”) govern your access to and use of the AutoMechanics mobile application and related marketplace services (the “Service”) operated by AutoMechanics LLC (“AutoMechanics,” “we,” “us,” or “our”).
1. Acceptance
By creating an account, accessing, or using the Service, you agree to these Terms and the policies referenced herein, including the Privacy Policy. Where the Service requires affirmative acceptance, you must review and accept the applicable documents before continuing. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 18 years old, have legal capacity to enter a binding contract, provide accurate account information, maintain the security of your credentials, and use the Service only for lawful purposes. You are responsible for activity under your account.
3. Marketplace Role
AutoMechanics operates a technology marketplace that connects Customers seeking automotive services with independent Mechanics and service providers. Arranging a job through the platform does not, by itself, mean that AutoMechanics is the mechanic performing repairs. AutoMechanics facilitates matching, communications, job workflow tooling, and payment processing integrations; Mechanics perform the physical service as independent providers.
4. No Employment Representation
Mechanics are intended to operate as independent service providers, not as employees of AutoMechanics, subject to the Mechanic Service Provider Agreement and applicable law. Contract language alone does not conclusively determine legal worker classification.
5. Customer Responsibilities
Customers must:
- Provide accurate vehicle and contact information
- Describe problems honestly
- Provide a reasonably safe service location and lawful vehicle access
- Remove valuables where appropriate
- Disclose known hazards
- Communicate in good faith
- Pay authorized charges
- Refrain from harassment, threats, fraud, or unlawful conduct
6. Mechanic Responsibilities
Mechanics must comply with the Mechanic Service Provider Agreement, verification requirements applicable to their account, and marketplace policies before accepting paid work.
7. Quotes and Job Records
Mechanics may submit quotes based on available information. Quotes may change after inspection when additional work is discovered. Additional paid work requires appropriate Customer authorization through supported workflows. Users should review pricing before accepting. The platform’s authoritative accepted quote and job records govern the marketplace transaction, subject to applicable law. Unauthorized arbitrary charges are not permitted.
8. Payments
Payment processing may be handled by third-party processors (currently Stripe where configured). When you confirm payment, you authorize the displayed amounts, including disclosed platform/service fees. Refunds, disputes, payouts, and holds are further described in the Payment, Cancellation & Refund Policy. Implementation secrets and processor credentials are not disclosed in these Terms.
9. Cancellations and Refunds
Cancellations and refunds are governed by the Payment, Cancellation & Refund Policy. Any cancellation or no-show fees apply only when disclosed in the app before you confirm.
10. Taxes
Customers and Mechanics are responsible for taxes legally applicable to them, except taxes the platform is legally required to collect, report, withhold, or remit. AutoMechanics does not promise that Stripe or any processor automatically handles every Mechanic tax obligation.
11. Reviews
Reviews must be based on genuine interactions, truthful, relevant, non-threatening, non-discriminatory, and free of unlawful or private information of others. AutoMechanics may moderate content that violates policy.
12. Messaging
In-app messaging is for legitimate marketplace purposes only. Prohibited uses include threats, harassment, scams, spam, illegal content, account compromise attempts, malicious links, prohibited sexual content, and disclosure of another person’s sensitive information without authority.
You may not:
- Use AutoMechanics to find a Customer or Mechanic and then deliberately move the transaction off-platform to avoid platform/service fees. Sharing personal contact information or off-platform payment instructions to circumvent fees is prohibited. Ordinary job discussion (parts prices
- Diagnostic codes
- Scheduling) is not treated as circumvention by itself; intent and context matter
Communications may be reviewed automatically and by authorized personnel for safety, fraud prevention, harassment detection, marketplace integrity, fee-circumvention detection, and policy enforcement. Messages are not completely private.
13. Location
Location information may be used to identify a service location, match nearby Mechanics, calculate distance, facilitate routing, support an active service request, and investigate safety or fraud issues where legally permitted. See the Privacy Policy and Location Services Disclosure. OS-level location permission is separate from acceptance of these Terms.
14. Suspension and Termination
AutoMechanics may restrict or suspend accounts for legitimate reasons including fraud, threats, unsafe conduct, repeated serious policy violations, payment abuse, false verification, illegal activity, or security risk. Users may contact Support regarding account restrictions. Additional review or appeal processes may apply where required by law.
15. Intellectual Property
AutoMechanics branding, software, interfaces, and platform materials are protected. Users retain ownership of their content, subject to a limited license for AutoMechanics to host, display, moderate, secure, and operate the Service.
16. Prohibited Conduct
You may not:
- Engage in fraud
- Create fake accounts
- Impersonate others
- Manipulate reviews
- Attempt unauthorized access
- Scrape where prohibited
- Distribute malware
- Commit payment fraud
- Harass or threaten others
- Engage in unlawful discrimination
- Offer unlawful services
- Falsify credentials
- Use the Service to arrange work and then deliberately complete payment off-platform to avoid fees
17. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” AutoMechanics does not guarantee uninterrupted availability, that every Mechanic is suitable for every repair, or that marketplace matching will meet every expectation. Nothing in these Terms attempts to disclaim rights that cannot legally be waived.
18. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AUTOMECHANICS’S LIABILITY ARISING OUT OF THE SERVICE IS LIMITED IN A COMMERCIALLY REASONABLE MANNER. This section does not limit liability that cannot be limited under applicable law.
19. Indemnification
To the maximum extent permitted by law, you agree to defend and indemnify AutoMechanics LLC against claims arising from your misuse of the Service, your content, your breach of these Terms, or your unlawful conduct, except to the extent caused by AutoMechanics’s willful misconduct where such carve-out is required.
20. Governing Law
These Terms are governed by the laws of the State of Georgia, excluding conflict-of-law rules, unless a different governing law is required by applicable rules. County-specific venue is not designated in this section.
21. Dispute Resolution
Contact Support to resolve marketplace concerns. You may also pursue rights available under applicable law. Binding arbitration is not imposed by this section.
22. Changes
Material changes to required Terms or policies may be communicated in-app or by email. Where reacceptance is required, continued use of gated features may require accepting the updated version. Prior acceptance records are preserved; new versions create new acceptance records.
